BR Auction – Auction and Website Terms & Conditions

These terms govern your use of BR Auction’s website and services. By registering, participating in an auction, or making a purchase, you acknowledge and agree to these terms. Additional terms may apply to specific services, and unless they conflict with these terms, they will be considered part of this agreement. Defined terms are explained in Clause 23.

1. General Overview

• Items listed on BR Auction are consigned and require seller approval, unless explicitly stated otherwise.

• Payment methods accepted: cash, wire transfer, bank draft, Visa, and MasterCard.

• If an auction is won via the "Buy It Now" option, full payment (including taxes and applicable fees) is due immediately.

• Listing prices do not include the buyer’s fee or GST.

• All sales are final; items are sold "as-is, where-is" and become the buyer’s responsibility upon purchase.

• Buyers should arrange insurance immediately upon winning a bid. BR Auction does not provide insurance coverage for purchased items once the Bill of Sale is issued.

• Purchased assets should be removed from BR Auction’s premises promptly, as BR Auction’s insurance does not cover them after purchase.

2. Account Registration & Use

2.1 To access BR Auction’s services, users must create an account and may be required to provide credit or debit card details.

2.2 Account holders are responsible for maintaining the confidentiality of their passwords and any activity associated with their accounts. BR Auction is not liable for unauthorized use of an account. If you suspect unauthorized access, notify BR Auction immediately via the Contact Us section on the website.

2.3 All provided account information must be:

• Accurate, truthful, and complete.

• Not misleading, infringing on others’ rights, or violating any laws.

• Free of viruses, malware, or harmful content.

 

2.4 Account holders can cancel their accounts at any time.

 

2.5 BR Auction reserves the right to suspend, terminate, or refuse access to an account without prior notice if:

• A user violates any terms of this agreement.

• A buyer fails to complete a purchase or a seller refuses to deliver an asset.

• BR Auction believes the user’s actions harm its business reputation.

• Fraudulent or unethical activities are detected.

 

2.6 Users must not resell access to BR Auction’s services or use them for unauthorized commercial purposes.

3. Site Content & Liability

3.1 BR Auction sources information from reliable providers; however, it does not guarantee the accuracy, completeness, or reliability of any content.

 

3.2 BR Auction is not responsible for any content posted by third parties on its website and does not endorse or verify such content.

4. Eligibility to Participate

4.1 Users must be legally capable of forming binding contracts. The following conditions apply:

• Participants must be at least 18 years old.

• Participants must have a valid credit card with a sufficient credit limit to cover the non-refundable deposit required at the end of the auction.

5. Auction Process & Item Viewing

5.1 Auctions will begin at the specified start time with a minimum starting price.

 

5.2 Auction participants may view listed assets during designated inspection periods at either the seller’s premises or BR Auction’s location.

 

5.3 Prior to the auction, BR Auction will specify whether the highest bid includes or excludes GST.

 

5.4 All auction information is provided by the seller. BR Auction is not responsible for inaccuracies in asset descriptions.

 

5.5 BR Auction reserves the right to:

• Withdraw an asset from the auction at any time.

• Close an online auction earlier than scheduled.

• Reject bids at its discretion.

 

5.6 If an asset does not meet its reserve price, BR Auction is not obligated to sell it.

6. Bidding Rules

6.1 Bidding is regulated by BR Auction, and all bids are considered the maximum amount the bidder is willing to pay, excluding additional fees, taxes, and shipping costs.

 

6.2 Bids can be placed in two ways:

• Normal bid – A single bid at a specific amount.

• Maximum bid (for online auctions) – A user sets a maximum bid, and the system automatically increases their bid as needed.

 

6.3 If two bids are placed at the same price, priority is given based on:

• Time of bid placement (earlier bids take precedence).

• Quantity of items bid on (if applicable).

 

6.4 Sellers cannot place bids on their own items.

 

6.5 Bid manipulation (e.g., colluding with others to manipulate bidding prices) is strictly prohibited.

 

6.6 Bids cannot be retracted once placed.

 

6.7 The highest bidder at the end of the auction is the buyer (subject to seller approval) and is obligated to complete the purchase.

 

6.8 If a dispute arises regarding the winning bidder, BR Auction has full discretion to either:

• Determine the final buyer.

• Re-offer the item in a new auction.

 

6.9 For online auctions, BR Auction will notify the highest bidder via email, but bidders are responsible for monitoring auction results.

 

6.10 Anti-sniping protection: To prevent last-second bid manipulation, BR Auction’s system extends the auction by 30 seconds whenever a bid is placed in the final 30 seconds. This continues until bidding ceases.

7. Payment & Fees

7.1 Buyers must pay the full purchase amount promptly, including:

• Applicable taxes.

• Buyer’s fees.

• Shipping, import duties, and brokerage fees, which are the buyer’s responsibility.

 

7.2 Payment delays may result in account suspension or cancellation of the transaction.

8. Item Pickup & Responsibility

8.1 Buyers must collect purchased assets immediately after payment.

 

8.2 Once the Bill of Sale is issued, the asset is no longer covered under BR Auction’s insurance. Buyers are encouraged to arrange insurance coverage immediately.

9. Liability Disclaimer

9.1 BR Auction does not provide warranties on any auctioned assets. Buyers assume all risks and should conduct inspections before bidding.

 

9.2 BR Auction is not liable for:

• Errors in listing descriptions.

• Damage, loss, or defects in auctioned assets.

• Any costs incurred by buyers post-purchase.

10. Final Provisions

10.1 In the event of disputes, BR Auction’s decision is final.

 

10.2 BR Auction reserves the right to amend these terms at any time. Continued use of the website constitutes acceptance of any updates.
